1. Overview

Your privacy is important to all of us at Pangea Social, Inc. (the “Company”, “we”, “our”, or “us”). It is our policy to respect the privacy of our users regarding all information we may collect through the operation of the social network.

This policy describes among other things, how and why we collect data about you when you use our Network, what data we collect, what we do with that data, how we look after it, and what your rights are in relation to it.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Network. By accessing or using our Network, you agree to this privacy policy. This policy may change from time to time (see Section [16]). Your continued use of the Network after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

The Network is encrypted via HTTPS, and we encrypt and/or hash all sensitive information while in motion or when stored at rest, including emails, passwords, and private messages.

2. Data We Collect About You

Certain features of the Network may require you to submit information (including personal information, which is defined below) as a condition to use certain features of the Network. “Personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual (e.g., a verified name, fingerprints or other biometric data, email address, street address, telephone number or social security number).

The personal information we collect via or in relation to the Network can be split into three broad categories: information you provide to us; information collected automatically; and information we obtain from third parties.

Information You Provide To Us.

We may ask for and collect the following information when create an account and/or use the Network:

  • Identity and Profile Information: We require you to provide certain personal information to create an account on the Network. The personal information we require includes your email address.
  • Payment Information: We may request your credit card or other payment information to collect payment for purchases made through the Network. We use Stripe, a third-party provider to process the credit card information and do not store your payment information. The use and storage of your payment information is governed by the own privacy policy of such provider.
  • Communications: When you communicate with us by email, or through/via the Network, we collect information about your communication and any information you choose to provide.
Information Collected Automatically

We may use automatic data collection technologies and collect certain information automatically when you use the Network. This information includes:

  • Interaction information and history: Information about your interactions and history with the Network, including the pages that you visit and links you click on, search history, logs, and location data, the time, frequency and duration of your Network visits and uses, and what features you used; Information about your computer and internet connection, including your IP address, device type, operating system, and browser type; and country, region, and city.
  • Cookies: Like many websites on the Internet, when you visit the Network, the Company may assign your computer one or more cookies to facilitate access to the Network and to personalize your online experience. Through the use of a cookie, the Company also may automatically collect information about your online activity on the Network, such as the web pages you visit, the time and date of your visits, the links you click, and the searches you conduct on the Network. The Company may use this data to better understand how you interact with the Network, to monitor aggregate usage by our users and web traffic routing on the Network, and to improve the Network. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. If you choose to decline cookies, please note that you may not be able use some of the interactive features offered on the Network. In addition, please be aware that other parties may also place their own cookies on or through the Network and may collect or solicit personal information from you. Other cookies may reflect de-identified demographic or other data linked to the registration data you have submitted to the Company in hashed, non-human readable form. No personally identifiable information is contained in these cookies.

The information we collect automatically may include personal information. It helps us to improve our Network and to deliver a better and more personalized service, including by enabling us to: estimate our audience size and usage patterns; store information about your preferences, allowing us to customize our Network according to your individual interests; speed up your searches; recognize you when you return to our Network.

Information We Obtain From Third Parties.

We may also receive information about you from our service providers and business partners, including companies that assist with the operation and hosting of the Network, as well as analytics, data processing and management, account management, customer and technical support, and other services which we use to personalize your experience on the Network. When we receive information from other sources, we rely on them having the appropriate provisions in place telling you how they collect data and who they may share it with.

3. Use of Personal Information

We will use the personal information to:

  • Carry out our obligations arising from any contracts entered into between you and us and to provide you with the Network;
  • Better understand our users;
  • Respond to your enquiries or to process your requests in relation to your information;
  • Notify you about your account and important changes or developments to our Network;
  • Process payments for services, and complete other Network-related purchases and payments;
  • Ensure that the Network are being presented in the most effective manner for you, making the Network easier for you to use and to provide you with a smooth, efficient, safe and tailored experience;
  • Detect and protect us against error, fraud and other criminal activity, and enforce our agreements;
  • Administer the Network and for internal operations, including troubleshooting, data analysis, testing, research, and statistical purposes;
  • Improve the Network and user experience to ensure that content is presented in the most effective manner for you;
  • Allow you to participate in interactive features of our Network, when you choose to do so; and
  • Be used as part of our efforts to keep the Network safe and secure.
  • In any other way we may describe when you provide the information; and
  • For any other purpose with your consent.

4. Sharing Your Personal Information

The following describes the ways we may share your personal information in the normal course of business and in order to provide our Network.

With your consent: We will disclose your personal information when and if you have agreed that we may do so. We will make this clear to you at the point at which we collect your personal information, including the purpose(s) for which we will use the personal information.

Intended purpose: We will use your personal information to fulfill the purpose for which you provide it, or for any other purpose disclosed by us when you provide the information.

Service providers: We use contractors, service providers, and other third parties to facilitate or outsource some aspects of our Network and some of these service providers will process your personal information. These third parties’ collection and use of information are subject to their own privacy policies.

If required by law: We may be required to disclose your personal information by law, in response to a valid order of a court or other authority, or to respond to regulatory requests or requests relating to criminal investigations.

Change of control: We may transfer your personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Network users is among the assets transferred. If this happens, you will be informed of this transfer.

Enforcing our terms of use: We may disclose your personal information to enforce or apply our terms of use and other agreements, including for billing and collection purposes.

Protecting our rights: We may disclose your personal information if we feel this is necessary in order to protect or defend our legitimate rights and interests and/or to ensure the safety and security of the Network.

Subsidiaries and affiliates: We may disclose your personal information to our subsidiaries and affiliates, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

5. Data Security

The Company (either itself or through third party service providers) maintains a variety of commercially reasonable electronic and procedural safeguards designed to protect your personal information from unauthorized access, use, alteration and disclosure. For example, we use accepted tools and techniques to protect against unauthorized access to our systems. You should be aware that we have no control over the security of other sites on the Internet that you might visit or with which you might interact even when a link may appear to another site from one of the Network. You must play your part in the safety and security of your information. Where we have given you (or where you have chosen) a password for access to certain parts of our Network, you are responsible for keeping this password confidential and thus must not to share your password with anyone. We want you to feel confident using the Network, but no system can be completely secure. Therefore, although we takes steps to secure your information, we do not promise, and you should not expect, that your personal information or communications will always remain secure. In the event of a breach of the confidentiality or security of your information, including your personal information, we will notify you as necessary and if possible so you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) that we have on record for you. You also should carefully handle and disclose your personal information.

Like most website operators, the Company also collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. The Company’ purpose in collecting non-personally identifying information is to better understand how the Company’ visitors use its website. From time to time, the Company may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

6. Notification and Disclosure of Breach

The Company will notify users if we believe their Personal Information is disclosed in any unauthorized way. Although the Company provides reasonable administrative, physical and electronic security measures to protect Personal Information from unauthorized access, we cannot assure the security of any information you transmit or guarantee that this information will not be accessed, disclosed, altered, or destroyed.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted Personal Information. To the extent the law of your jurisdiction allows for notification of a breach via e-mail or public posting, you agree to accept notice in that form.

If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users.

7. Updating and Retention of Your Data

For instructions on accessing or correcting your information, or to request a copy of the information we hold about you, please contact us by email at privacy@pangeasocial.com. Please note that we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We retain your personal information as long as we are providing the Network to you. We retain your personal information after we cease providing the Network to you, even if you delete your account, to the extent necessary to fulfill your request (for example, keeping your email address to make sure it’s not on our mailing list); to comply with our legal and regulatory obligations; for the purpose of fraud monitoring, detection and prevention; to comply with our tax, accounting, and financial reporting obligations; or where we are required to retain the data by our contractual commitments to our partners. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law. Even if you delete your account and we delete your information from our systems, keep in mind that the deletion by our third-party providers may not be immediate and that the deleted information may persist in backup copies for a reasonable period of time.

8. How Long We Keep Your Information

Personal Information that you provide to the Network may be retained indefinitely, to the extent it is consistent with our Terms of Use and applicable law. The Company may in its discretion elect to retain Personal Information only while deemed necessary for business, legal and tax purposes.

9. Children

The Network are not intended for use by children. Individuals under the age of 18 are not permitted to use the Network and must not attempt to register an account or submit any personal information to us. We do not knowingly collect any personal information from any person who is under the age of 18, allow them to register an account. If it comes to our attention that we have collected personal information from a person under the age of 18, we will delete this information as quickly as possible.

If you are a parent or guardian and you learn that your child has provided us with personal information, please notify us immediately at privacy@pangeasocial.com.

10. Government, Regulatory Agencies, Courts, and Law Enforcement

We may access, preserve, and share any information about you, without your consent, to government or law enforcement officials or private parties if we believe in good faith that it is necessary or appropriate to respond to requests, claims and legal process (including, but not limited to, subpoenas), to comply with applicable laws, to protect the property and rights of the Company, you or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to pose a risk of being, or is, illegal, unethical or legally actionable.

We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of audits, inquiries or investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

If you voluntarily share or submit any information (e.g., name) or content (e.g., pictures), or commentary (e.g., forums, message boards, chats) through the Network, or link it to any social media platforms, you acknowledge that the post and any content or information associated with it may become available to the public.

11. Business Transfers

If the Company, or substantially all of its assets, were acquired, or in the unlikely event that the Company goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of the Company may continue to use your Personal Information as set forth in this policy. At any time users are able to delete all content and personally identifiable information from the site.

12. How We Respond to Do Not Track Signals

The Company does not track its users over time and across third party websites to provide targeted advertising. We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the preferences or settings page of your web browser. For further details, visit donottrack.us.

13. Other Websites and Services

The Network may contain links to other websites or services that we do not own or operate. We are not responsible for the practices employed by any websites or services linked to or from the Network, including the information or content contained within them. Your browsing and interaction on any third-party website or service, including those that have a link on our Network, are subject to that third party’s own rules and policies, not ours. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your Personal Information. If you are using a third-party website or service and you allow them to access your Personal Information you do so at your own risk.

14. International Considerations

We have developed data practices designed to assure all the Company information is appropriately protected, but we cannot always know where Personal Information may be accessed or processed. While our primary facilities are in the United States, we may transfer Personal Information or other information to facilities outside of the United States. In addition, we may employ other companies and individuals to perform functions on our behalf. If we disclose Personal Information to a third party or to our employees outside of the United States, we will seek assurances that any information we may provide to them is safeguarded adequately and in accordance with this Privacy Policy and applicable privacy laws.

If you live in or you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your Personal Information, including sensitive data, by us from your region to countries which may not have data protection laws that provide the same level of protection that exists in countries in the European Economic Area, including the United States. By providing your Personal Information, you consent to any transfer and processing in accordance with this policy.

15. Residents of Certain States

California. California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. We do not currently disclose any information to third parties for direct marketing purposes.

Nevada. We do not currently sell your “personally identifiable information” as defined under applicable Nevada law and will not sell it without providing a right to opt out.

16. Privacy Policy Changes and Further Information

Although most changes are likely to be minor, the Company may change its Privacy Policy from time to time, and in the Company’ sole discretion. The Company advises you to frequently check this page for any changes to its Privacy Policy. Your continued use of the Network after any change in this Privacy Policy will constitute your acceptance of such changes.
